Hi,
My company applied for PERM for me. Short of asking our HR/attorney everyday what is the way to check status.
Its applied just last week and but I can resist the urge to check the status already (anxious because I need H1B extension soon). Any advice is appreciated. thanks.

As long as the job responsibilities and duties match with what you are already performing, it is 100% safe to switch jobs . I had the same issue last year and I spoke with an attorney at Murthy law firm and based on which I started working with the new company. I did inform USCIS and everthing is working well so far.

I got my 140 approved.Is there any deadline date like with in 90 days i have to apply for 485 or else it will expire.I am single so i dont want to get in to any trouble by applying for 485.

Hi,
My H1 was denied the last cycle. The denial decision was posted on Nov 24th. My application was in RFE state for quite some time, hence the delay. The question that I have is, as the denial came very late, will I be able to apply for an H1B this year. We generally file all our documents on 3.31, I am wondering if I would not be eligible this year because 3.31 is not 6 months from 11.24. There is an rule that I cannot apply if there has been a denial in the recent 6 months. Please let me know if that is the case. Will I be ineligible for this year (3.2010).
I am currently in my 4th year on a L1.

I got my labor approved in Jan (EB2 - RIR) , I say EB2 because because all the documentation was done supporting EB2 (BS + 5 years). My job requires that and I meet the criteria.
However, when Applying my I140 , the lawyer screwed up and filed under EB3 and got approved.
I very much want to go for EB2. Is it possible to file I140 again under EB2 with the same LC? If I want to re-file, do I have to or do they (USICS) cancel my previous I140 approval ?
Is filing another LC under PERM and I140 safer route than using the current LC ?
What is the best course of action ?
I know there is a clear advantage today in being in EB2 over EB3 (PD wise) and it looks like most people are converting from EB3 to EB2. I am not sure whether there will be any advantage of being in EB2 over EB3 by the time my PD (oct 04) becomes current.
Any input is appreciated. Thanks in advance guys.

My fiancee is from Tijuana, Mexico and she has two children aged 11 and 14. They all have BCC laser visas, which allow multiple crossings into the US. I am a US citizen and live in San Diego, 25 miles from the border.
Here's my concern: her 14-yr old daughter will turn 15 on Jan 8, 2008, at which her BCC visa expires.
If my fiancee and I get married after the expiration date of her daughter's visa, and I file for the family-based adjustment of status I-485, will that affect our application process?
In other words, do my fiancee's and her children's BCC visas need to be current in order for their applications to be approved? Will the daughter's visa need to be renewed before we can move forward? :confused:

if your used to the easy layout of cinema 3d (like me) then stick to it cause its alot easyer to use that 3d studio max then when you get more used to 3d design then you should maybe choose to start using 3d studio max.

I have applied EAD for my wife... while applying I misspelt my wife's first name and I haven't selected any service center, seems it automatically choosen NSC... but my 485 applied under TSC and the dates here are best like May 20, 2008 and the NBC is Mar 31, 2008...
How can I correct the name, can I do it at the time of finger print?

I already sent email to EAD Deptt... In the meanwhile, I wd like to find from many experienced people like you...

Now that USCIS has dropped bomb by announcing the revised bulletin, do you think now they will be able to bring back the premium processing for I-140? or still they dont have time to "ensure" processing in 15 days.

Thanks to IV for making the multi year EAD/AP happen. Since USCIS might or might not announce this, I want to track when people start getting these multi year EAD/APs. Anyone in the IV community got one of these yet?

2. I am on L1A with company A from February 2008 which is valid till December 2010 (my 7 year limit on L1A ends by December 2010).
3. My Labor is applied in October, 2009 by company B.
If my labor is approved or labor pending for 1 year, can I reactivate my old H1B with company B and start working with them.
Please advise. Mr. Dhoni

I am currently on H1b and had recently filed papers for transfer from employer A to employer B. I have got the email from USCIS that my case has been approved and that documents will be delivered soon.
My H1b transfer has been accepted for 01/01/2010. My date of joining the new job is 01/04/2010. My original H1b with company A is still valid till Oct 2009.
Since I have to give my old employer a two weeks notice to resign. If I give my notice around 12/21/2009 (notice period of leaving by 01/04/2010) and my employer relieves (terminates) me immediately will I be out of status at any time?
Also, My green card process is going to start soon. Is it going to affect me as I am worried that I might be out of visa status from 12/21/2009 to 01/01/2010.
Please suggest. I need to make a decision in few day.
